1. Scope and seller
These terms apply to all orders placed on clightstore.com with C-Light Projects BV, trading as Clightstore, registered office Molenweg 132, 3660 Oudsbergen, Belgium, business address Bekaertlaan 6, 3650 Dilsen-Stokkem, Belgium, company number 0834.221.180, VAT BE0834221180, email sales@clightstore.com, telephone +32 468 25 01 43 ("we"). We sell to businesses and to consumers. A consumer is any natural person who buys for purposes outside their trade, business or profession. Deviating purchasing conditions of business customers do not apply unless we accept them in writing.
2. Conclusion of the contract
The products on our website are not a binding offer but an invitation to order. You place products in the cart, enter your details in the checkout, choose a shipping and payment method and can review and correct all entries before you submit the order. By clicking the final order button you make a binding offer to buy. The contract is concluded when we send you the order confirmation by email. In the case of an obvious error in price or product data, we may cancel the order in accordance with the applicable law; any amount already paid will be refunded immediately.
3. Contract language and storage
The contract can be concluded in English, German, Dutch, French and the other languages offered on the website. We store the contract text. You receive your order details by email, and these terms can be viewed and saved on this page at any time.
4. Prices and VAT
Prices include the statutory VAT of your country of delivery within the EU, plus the shipping costs shown before you place the order. Business customers established in another EU member state who enter a valid VAT number that is verified at checkout are invoiced without VAT under the reverse-charge mechanism (Article 196 of Directive 2006/112/EC). Businesses established in Belgium are always invoiced with Belgian VAT. For deliveries outside the EU, including the United Kingdom, import VAT, customs duties and clearance fees may be charged on import unless the checkout shows them as included. Prices shown in other currencies are converted from euro; the amount charged is the one shown at checkout.
5. Payment and retention of title
You pay at checkout with one of the payment methods offered. Orders paid by bank transfer are processed after receipt of payment. We may agree payment on invoice with business customers in writing; for business customers, late payment gives rise by operation of law and without notice to interest at the statutory rate for commercial transactions (Belgian Act of 2 August 2002) and a fixed compensation of 10% of the outstanding amount, with a minimum of €75. Products remain our property until full payment.
6. Delivery
We deliver within the European Union and to the United Kingdom. Products in stock are dispatched within 1–2 business days and usually delivered within 2–5 business days, depending on the destination. Products on request are delivered within the period stated in the order confirmation. Partial deliveries are possible if they are reasonable for you; we bear any extra shipping costs. For consumers, risk passes on delivery; for business customers, risk passes when the goods are handed to the carrier. More information: our shipping policy.
7. Right of withdrawal and returns
Consumers have a statutory right of withdrawal of 14 days. The conditions, the model withdrawal form and our online withdrawal function are on our right of withdrawal page. The right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. In addition, all customers can return unused products within 30 days under our return policy; this voluntary return guarantee does not limit your statutory rights.
8. Legal guarantee and manufacturer warranty
Consumers are entitled to the statutory guarantee of conformity of two years from delivery. For business customers, visible defects must be reported within 8 days of delivery and hidden defects within 8 days of discovery; we then repair or replace the product or refund the price, at our choice. In addition, our products carry a commercial warranty of up to 5 years as stated on the product page, covering defects in materials and workmanship under normal use. The warranty requires installation by a qualified electrician in accordance with the applicable regulations and the product instructions, and does not cover damage caused by incorrect installation, overvoltage, lightning, use outside the specifications, modifications or normal wear. The warranty is in addition to, and does not limit, the statutory guarantee.
9. Liability
We are liable without limitation for intent and gross negligence, for death or personal injury and under the product liability rules. Otherwise, towards business customers our liability is limited to the invoiced value of the products concerned and excludes indirect damage such as loss of production, loss of profit or third-party costs. The mandatory rights of consumers remain unaffected.
10. Light studies and advice
Light studies (DIALux) and technical advice are provided free of charge as a planning aid based on the data you supply. You remain responsible for checking them against the actual situation and the applicable standards.
11. Intellectual property
All content on clightstore.com, including texts, photos, light studies and designs, is our property or used with permission and may not be reproduced without our written consent.
12. Privacy
We process personal data in accordance with the GDPR, as described in our privacy policy.
13. Applicable law, jurisdiction and disputes
Belgian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law does not deprive them of the protection of the mandatory provisions of the law of their country of habitual residence. For business customers, the courts of Hasselt (Belgium) have exclusive jurisdiction. We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration board; please contact us first at sales@clightstore.com.
14. Severability
If any provision of these terms is invalid, the remaining provisions remain in force.
